South African media personality and anti-migrant activist Ngizwe Mchunu has been found guilty of hate speech targeting the LGBTQ+ community, with the Johannesburg High Court ordering him to pay a fine of R250,000 and comply with additional remedial measures.

The court ruling is a major setback for Mchunu, whose outspoken comments have often stirred controversy around race, sexuality, and migration. In this case, the court found that his remarks went beyond opinion and crossed into unlawful discrimination and hate speech.

Court order

Alongside the R250,000 fine, the court ordered Mchunu to issue an unconditional apology to LGBTQ+ people, publish it on his Facebook page for three months, and undergo human-rights sensitisation training. He was also ordered to pay the legal costs of the complainants and stop publishing discriminatory content against LGBTQIA+ communities.

The ruling means Mchunu now faces both financial punishment and corrective requirements designed to address the harm caused by his statements.

Why it matters

The case has drawn attention because it touches on a sensitive balance between freedom of expression and the legal protection of vulnerable groups. South Africa’s courts have repeatedly made it clear that public figures are not exempt from laws against hate speech, harassment, or unfair discrimination.

For supporters of LGBTQ+ rights, the judgment is likely to be seen as an important victory. For Mchunu’s critics, it reinforces the idea that influential voices should be held accountable when their speech targets protected communities.

Public reaction

Mchunu has long been a polarizing figure in South African public debate, especially on migration and identity issues. This latest ruling is likely to intensify discussion about the role of social media personalities in shaping public opinion and the consequences of inflammatory speech.

The judgment also serves as a warning to other public figures that controversial commentary can carry serious legal consequences when it crosses into hate speech.
